High Point, NC

Short answerYes: the City of High Point code allows up to 5 birds; roosters are banned; the cited code does not mention a permit; and the coop setback is 40 ft.

Buying notes for backyard hens inside the City of High Point corporate limits. HOA covenants and county rules outside city limits can differ.

Heads up: These rules apply inside the City of High Point corporate limits only. An HOA or neighborhood covenant can still ban hens. Those private rules are usually not public, so HenCheck does not look them up.

The rule, quoted

Word for word from Sec. 12-2-2. Requirements of pens and enclosures for chickens, pigeons, rabbits, etc.

How many hens

“A maximum of five (5) chickens may be kept per dwelling house and in no event shall the keeping of any animals under this section be allowed for any multifamily dwelling structures.”

Sec. 12-2-2. Requirements of pens and enclosures for chickens, pigeons, rabbits, etc.

Roosters

“The keeping of chickens under this section shall be limited to hens and the keeping male chickens (roosters) shall be prohibited.”

Permit and fee

Code does not mention a permit. Ask the city whether a permit is needed before you buy birds.

Setback / screening

“It shall be unlawful for any person to keep enclosures for fowl and/or small animals under this section within 40 feet of any dwelling house or structure used as a dwelling house, unless the house or structure is occupied by the owner of the animal or fowl.”

The 40 ft is measured to any home other than yours, not to the property line.

Also in this section

“Any enclosure under this section must be located in the back yard of the dwelling house and must be of sufficient height and material as to prevent the animals from leaving the enclosure and prevent predators or rodents from entering the enclosure.”
“All enclosures under this section must be physically separate from the dwelling house.”
“No commercial sale of chickens or chicken products, except eggs, is allowed under this section.”
